2. Champ d’application
These General Terms and Conditions of Sale govern the sale of products made on the Char3i Barber website to consumers.
The customer acknowledges having read these terms before confirming their order.
3. Produits
The essential characteristics of the products are presented on their respective product pages.
Char3i Barber strives to present the products, their compositions, variants, prices, and availability as accurately as possible.
Photographs are for presentation purposes only. Slight differences in color or rendering may result from the screen used.
Products are offered subject to availability.
4. Prix
The applicable prices are those displayed at the time of order confirmation. They are indicated in euros.
Char3i Barber currently benefits from the VAT franchise regime.
Any delivery charges are indicated before final order confirmation. The total amount to be paid is presented to the customer before confirming their purchase.
Char3i Barber may change its prices at any time, without retroactive effect on orders already confirmed.
5. Commande
The customer selects the desired products and options, then checks their basket before placing the order.
Before final confirmation, they can check the products, quantities, and variants, correct errors, review the total price and delivery costs, and accept these General Terms and Conditions of Sale.
Payment confirmation constitutes the conclusion of the order, subject to payment acceptance and product availability. A confirmation is sent to the customer by email.
Char3i Barber may refuse or cancel an order in the event of suspected fraud, payment failure, manifest error, or product unavailability. In case of cancellation after payment, the relevant sums will be refunded.
6. Paiement
Payment is made using the solutions offered at checkout.
The payment methods actually available are those displayed to the customer before order confirmation.
Payment is processed by secure payment providers. Char3i Barber does not have access to the full credit card number used for payment when processed directly by the relevant provider.
7. Abonnements
Certain products may be offered as recurring deliveries.
Before subscribing, the customer is informed of the price, any discount, delivery and billing frequency, and applicable terms.
When the customer chooses a subscription plan, subsequent orders and payments are generated according to the selected frequency until cancellation.
The customer can manage their subscription via the space, link, or management tool provided. Cancellation prevents future recurring orders according to the indicated terms but does not automatically cancel an order already processed or shipped.
8. Livraison
Products are delivered to the destinations offered at the time of ordering.
For France, Belgium, and Luxembourg, the current rates are:
Pickup point:
3,90 €.
Free on orders over 49 €.
Home delivery:
6.90 € for any order under 99 €.
Free on orders over 99 €.
Express France: 11,95 €.
Express Belgium and Luxembourg: 17,90 €.
The delivery methods actually available, their rates, and the estimated delivery time are displayed at checkout based on the destination and the order.
The customer must provide an address and contact details that allow for delivery.
In the event of an error in the address attributable to the customer or failure to collect a parcel from a pickup point resulting in the return of the parcel, fees corresponding to a new shipment may be requested before reshipment.
When the seller and the customer have not agreed on a specific delivery date or timeframe, the legal provisions regarding the maximum delivery time apply.
The risk of loss or damage to the goods remains the responsibility of CHAR3I BARBER until the moment the customer, or a third party designated by them other than the carrier, takes physical possession of the goods, except for exceptions provided by law when the customer chooses a carrier not offered by the seller.
9. Retard ou absence de livraison

In the event of a problem with a carrier, CHAR3I BARBER remains the customer's point of contact for the execution of the contract, without prejudice to cases where the problem results directly from incorrect information provided by the customer or an act attributable to them.
10. Droit de rétractation
For distance purchases, the consumer generally has a period of fourteen (14) days from receipt of the goods to notify their decision to withdraw, without having to justify any reason.
When multiple goods from the same order are delivered separately, the period runs from the receipt of the last good.

The customer may use the withdrawal form provided at the end of these Terms and Conditions or any other unambiguous statement expressing their wish to withdraw.
The customer then has a maximum of fourteen (14) days to return the products. Unless otherwise indicated by CHAR3I BARBER, the direct costs of return are borne by the customer.
The goods must be returned with any accessories provided and in a condition that allows the product and the order to be identified.
Exception for certain unsealed products
In accordance with legal exceptions to the right of withdrawal, a product delivered sealed and which, for reasons of health protection or hygiene, cannot be returned after being unsealed, no longer benefits from the right of withdrawal once unsealed.
This exception does not affect the customer's rights in the event of a defective, damaged, or non-conforming product.
11. Remboursement après rétractation
In the event of a valid withdrawal, CHAR3I BARBER will refund the sums due in accordance with the law, including the cost of the initial standard delivery when this must legally be refunded.
Any additional costs resulting from the voluntary choice of a delivery method more expensive than the standard method offered are not refunded beyond the cost of standard delivery.
The refund will be made no later than the applicable legal deadline from the notification of the decision to withdraw.
CHAR3I BARBER may defer the refund until the goods are recovered or until proof of shipment of the goods is received, whichever is earlier.
The refund is made using the same payment method as that used during the order, unless expressly agreed otherwise for another method that does not incur costs.
12. Produit endommagé, erroné ou non conforme
Si le client reçoit un produit endommagé, un produit différent de celui commandé ou constate un défaut de conformité, il doit contacter Char3i Barber dès que possible à [email protected].
It is recommended to include the order number as well as photographs that help understand the problem. This recommendation does not limit the consumer's legal rights and does not impose a 24 or 48-hour deadline to benefit from the guarantees provided by law.
13. Garanties légales
The products sold benefit from the legal guarantee of conformity provided by articles L.217-1 and following of the Consumer Code as well as the guarantee relating to hidden defects provided by articles 1641 and following of the Civil Code.

The legal guarantee of conformity applies in particular when a product does not correspond to the description or characteristics provided in the contract. The consumer has the rights and deadlines provided by the legal provisions in force.
14. Responsabilité
CHAR3I BARBER is responsible for the proper execution of the obligations resulting from the contract under the conditions provided by law.
However, the liability of CHAR3I BARBER cannot be engaged when non-performance results from a force majeure event or an act directly attributable to the customer, under the conditions provided by law.
No provision of these Terms and Conditions limits or excludes the mandatory rights enjoyed by the consumer.
15. Données personnelles
Personal data necessary for the management of orders and customer relations are processed in accordance with the Privacy Policy available on the site.
16. Propriété intellectuelle
The contents of the CHAR3I BARBER site remain protected by applicable intellectual property rights. The purchase of a product does not confer any right over the trademarks, photographs, texts, visuals, or other content of CHAR3I BARBER.

18. Droit applicable
These General Terms and Conditions of Sale are subject to French law, subject to mandatory provisions that may be more protective and applicable to the consumer due to their place of residence.
In the event of a dispute and in the absence of an amicable solution or mediation, the competent courts are those determined by the applicable legal rules.
